2. The petitioner apprehends his arrest for the offences alleged under Section 498 of the Indian Penal Code registered in connection with Complaint Case No. 153 of 2023.

3. The matter originates from the matrimonial discord.

4. Both the parties are present in Chambers with their respective counsels, casting allegations and counter allegation against each other.

5. For the purpose of negotiating peace with the warring couple to save their marriage and also keeping in view

No.7021 of 2025(5) dt.14-10-2025 2/3 the welfare of the children born out of their wedlock, earlier the matter was referred to the Patna High Court Mediation and Conciliation Centre. The report of the learned Mediator shows that the dispute has been resolved through the process of mediation with the terms of agreement being attached with the mediation report at Flag-M.

6. The learned counsel for the complainant has submitted that the petitioner has continuously been torturing the victim even after the agreement being reached at between them. So it is not possible for the victim to live with her husband.

7. The learned counsel for the petitioner has submitted that the petitioner is a labourer in Delhi and does not have such means to give the amount of maintenance.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class Dehrion-Sone, Rohtas, in connection with Complaint Case No. 153 of 2023 subject to the followings conditions:- (i). The petitioner shall make payment of Rs.

Patna High Court CR. MISC. No.7021 of 2025(5) dt.14-10-2025 3/3 2000/- each (Rupees two thousand) per month, as an interim maintenance, to his children. He is also directed to pay Rs. 2000/- ((Rupees two thousand) per month to the complainant (o.p.no.2), as an interim maintenance.

(ii). If the petitioner fails to pay the amount of interim maintenance to his children and the complainant on two dates consecutively, his bail bond shall stand cancelled.
