The petitioner has preferred this application for grant of regular bail in a case registered under section 414 of the Indian Penal Code and sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 630 litres of liquor was recovered from the vehicle in which the petitioner was also one of the occupants.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from possession of the petitioner. He has been falsely implicated in the case. He is in custody since 9.11.2020 and investigation in the case has concluded. It is further submitted that pursuant to

Patna High Court CR. MISC. No.15836 of 2021(6) dt.15-11-2021 2/2 the error in the statement made in paragraph no. 3 of the petition with respect to the antecedent of the petitioner, a supplementary affidavit has already been filed and also a cost of Rs. 10,000/- as directed by the Court has been deposited.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the the petitioner having remained in custody for one year, the petitioner is directed to be enlarged on bail in connection with Gopalganj (Town) P.S. Case no. 630 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum- Special Judge, Excise, Gopalganj. (Partha Sarthy, J) Spd/- U T
