2. The present petition has been preferred for the following reliefs:

(i) to issue writ in the nature of writ(s) of certiorari for quashing the Notice dated 31.7.14 issued by the Respondents Circle Officer (as contained in Annexure-8), whereby the petitioner has been directed to explain as to why the Land appertaining to Khata no. 23, Khesra no.

632, 646, 647, 649, 629 etc. situated at

Patna High Court CWJC No.5219 of 2017(6) dt.15-04-2025 2/3 Mauza Devgana measuring about 5.63 acres is still in physical possession of the petitioner, although those lands have already been distributed amongst the landless persons.

(ii) to issue writ in the nature of the writ of mandamus directing the Respondents not to disturb the physical possession of the petitioner of the land appertaining to Khata no. 23 as aforesaid, since the matter with respect to declaration of surplus land under the provision of Bihar Land Ceiling Act, 1961 is Sub-Judice before the learned Judge-1, Bikramganj in T.S. no. 458/2000/1729/2015 and injunction petition has already been filed before the learned Court below for grant of temporary injunction;

(iii) to pass any other order(s), direction(s) as this Hon'ble court may deem fit and proper in the facts and circumstances of the case.

3. Learned counsel for the petitioner prays for withdrawal of the petition.

4. Accordingly, the C.W.J.C. No. 5219 of 2017 is dismissed as withdrawn.
