The petitioner is languishing in custody since 28.11.2018 in connection with Pipra P.S. Case No.276 of 2018 registered under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

As per the written report, 51 litres of illicit Nepali liquor was recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that recovery has been made from the joint house of the petitioner, hence, it cannot be treated as petitioner's house. It is further submitted that the petitioner is having no criminal antecedent.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above

Patna High Court Cr.Misc. No.1802 of 2019(2) dt.15-01-2019 2/2 named, is directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-cum-Special Judge-2nd, Supaul in connection with Pipra P.S. Case No.276 of 2018.
