Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners are in custody in a case registered under
Patna High Court Cr.Misc. No.21339 of 2015 (2) dt.14-07-2015 2/3 Sections 395 and 397 of the Indian Penal Code. The prosecution case in, brief, is that the informant Arun Kumar Roy had stated before the police that he was traveling by his Maruti Car and when he reached near Mohaniya, some un-known culprits surrounded him by over taking his vehicle and committed dacoity on the point of gun.They also assaulted him and his family members who sustained injury and they snatched Rs. 75,000/- from him and Rs. 1,25,000/- from his wife along with ornaments and several mobile phone sets. It has been submitted on behalf of the petitioners that the petitioners are in custody since 11.2.2015 and 6.2.2015 respectively. It is further submitted that the petitioners are not named in the FIR nor they have been put on T.I. parade. It has been submitted that the petitioners may be released after completion of nine months in custody from 11.2.2015 and 6.2.2015 respectively.
On behalf of the State, it has been submitted that the allegations against the petitioners are very serious and their names have appeared in course of investigation. Considering the facts aforesaid, let above named petitioners be released, after completion of nine months in custody from 11.2.2015 and 6.2.2015 respectively, on bail on furnishing
