====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 07-02-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in N.T.P.C. P.S. Case No. 70 of 2018, instituted for the offence under Section(s) 401, 420, 467 and 468/34 of the Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report. No Test Identification Parade has been held. Petitioner has been arrested merely on suspicion. From the written report it will appear that no occurrence was committed by this petitioner on the date of occurrence. He further submits that co-accused Sonu Kumar has already been granted bail by this Court vide order dated 24.01.2019 passed in Cr. Misc. 3288 of 2019.
Patna High Court Cr.Misc. No.1864 of 2019(3) dt.07-02-2019 2/2 In the written report, it is alleged that one Dinesh Kumar Yadav had told that he was cheated by some persons and on such suspicion this petitioner was apprehended. Petitioner is in custody since 6.10.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 7th, Bhagalpur, in connection with N.T.P.C.
