The petitioner seeks bail in connection with Special Case No. 5142 of 2021 arising out of Naubatpur P.S. Case No. 418 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.08.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 180 litres of liquor from a gallon. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name was disclosed by apprehended accused persons.

Patna High Court CR. MISC. No.4361 of 2022(2) dt.07-03-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 5142 of 2021 arising out of Naubatpur P.S. Case No. 418 of 2021.
