JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-10-2019 The learned counsel for the Accountant General has filed a counter affidavit wherein it has been stated that the full amount of pension and full amount of gratuity has been sanctioned in favour of the petitioner vide letter dated 30.07.2019 and thereafter authorization has also been issued vide order dated 11.09.2019. As far as the leave encashment amount is concerned, the authority for payment of the same has been issued in favour of the petitioner by an order which is annexed as Annexure-R6/6 to the counter affidavit filed on behalf of the respondent no. 6.

Patna High Court CWJC No.22705 of 2018(6) dt.14-10-2019 2/2 In such view of the matter, the learned counsel for the petitioner submits that in case the aforesaid amount has not been actually paid then the same be directed to be paid within a period of four weeks from today.

Having regard to the facts and circumstances of the case, the present writ petition stands disposed off in light of the statement made by the respondent no. 6 in the counter affidavit filed on behalf of the respondent no. 6 i.e. the Accountant General, Bihar, Patna, however, with a direction to the respondent authorities to make actual payment of the aforesaid amount, in case the same has not been paid, within a period of four weeks from today, failing which the Treasury Officer concerned shall not draw his salary.
