2. The petitioner seeks regular bail in a case registered for the offence under Sections 354, 354D, 509, 365/511 of the Indian Penal Code.
3. As per the prosecution case, the petitioner was caught red handed while he was misbehaving with victim girl and tried to make her sit on his motorcycle.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence and the petitioner is in custody since 24.10.2023.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.10932 of 2024(3) dt.18-04-2024 2/2 case, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Patna/concerned Court below in connection with Rajeev Nagar P.S. Case No. 709 of 2023 subject to condition that:- 7(i). The petitioner will mark his attendance at the Digha Police Station, Patna on the first & third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
7(ii). The petitioner will give an undertaking that he will not misbehave with any female.
