Petitioners apprehend arrest in connection with Turkaulia (Manjariya) P.S. Case No. 886 of 2021 registered for the offence punishable under sections 272, 273, 34 of the Indian Penal Code and Section 30(B)(c) of the Bihar Prohibition and Excise Act.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. Nothing has been recovered from the conscious possession of these petitioners. It is alleged that the said recovery has made
Patna High Court CR. MISC. No.5639 of 2023(2) dt.29-04-2023 2/2 from a place near the Bhatti of these petitioners. Petitioners have no concern with the seized article. Petitioners have no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing personal bond to the satisfaction of Exclusive Special Excise Court No. 1, Motihari, East Champaran in connection with Turkauliya (Banjariya) P.S. Case No. 886 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
