The petitioner seeks bail in a case instituted for the offences under Sections 395 and 397 of the Indian Penal Code. The prosecution case in short is that the accused persons on the point of pistol committed loot or ornaments as also from the house of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.4.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Chargesheet has been submitted in the present case. The petitioner is not named in the F.I.R.. The name of the petitioner has come on the basis of his self statement before the police. The petitioner has not been put on T.I.P. There is no recovery of any
Patna High Court CR. MISC. No.5232 of 2019(3) dt.12-04-2019 2/2 incriminating articles from the possession of the petitioner. Other co-accused has been granted bail vide order dated 28.11.2018 passed in Cr. Misc. No. 67703 of 2018. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R..
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Barhat P.S. Case No. 05/2018.
