The petitioner seeks regular bail in connection with Rajnagar P.S. Case No. 188 of 2017 registered for the offence punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Wine Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 705 litres of illicit liquor from the house of the co-accused, namely, Tara Devi.
The learned counsel for the petitioner submits that no recovery has been made from the conscious possession of the petitioner and the petitioner is languishing in custody since 26.11.2018. Lastly, it is submitted that similarly situated co-

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge-cum-Special Judge, Excise Act, Madhubani in connection with Rajnagar P.S. Case No. 188 of 2017.
