The petitioners seek anticipatory bail in connection with Narpatganj (Basamatiya) P.S.Case No. 496 of 2018, registered for offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.

Allegation as per the F.I.R. is that the petitioner No. 1, who is mother-in-law and petitioner Nos. 2 and 3 are Gotni of the deceased, is of throttling her and after her death, for the purpose of concealing her dead body they were preparing for the funeral of the deceased.

Submission of the learned counsel for the petitioners is that the petitioners have falsely been implicated in this case

Patna High Court Cr.Misc. No.250 of 2019(3) dt.05-02-2019 2/2 and the name of the petitioners by the informant was roped with ulterior motive and the petitioners have clean antecedent. Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- ( Twenty five thousand) each with two sureties of the like amount each in connection with Narpatganj (Basmatiya ) P.S.Case No. 496 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Araria, subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
