The petitioner seeks bail in Excise Case No. 190c3Ex/2019, registered for the offence under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act, 2018. As per prosecution case, 40.60 liters of country-made liquor is said to have been recovered and it is alleged that petitioner with another accused fled away on motorcycle after throwing the sack containing aforesaid liquor. It is further alleged that from the house of petitioner, one sacheting machine was also found.

It is submitted on behalf of petitioner that petitioner has falsely been implicated and nothing has been recovered

Patna High Court CR. MISC. No.3150 of 2020(3) dt.10-06-2020 2/2 from the possession of the petitioner. It is further submitted that save and except suspicion, there is nothing against petitioner. However, considering the fact that aforesaid liquor and a Sacheting Machine have been recovered from the house of petitioner and petitioner has also got criminal antecedent, I am not inclined to extend the privilege of anticipatory bail to the petitioner.
