This is a petition for grant of regular bail in a case under Section 392 of the Indian Penal Code.

It is alleged that the petitioner along with his friend having armed with pistol came at the medical shop of the informant and took cash of Rs. 15,000/- from the cash box and fled away.

It is submitted on behalf of the petitioner that generally, it is improbable that four persons will ride on a motorcycle together, which also falsifies the prosecution case. It is further submitted that both the informant and the petitioner were known to each other prior to this case and an altercation took

Patna High Court Cr.Misc. No.13242 of 2016 (2) dt.01-04-2016 2/2 place between them on the point of medicine and later on, the informant lodged this case with a false and concocted story. The petitioner is in custody since 12.12.2014.

Hence, having regard to the facts and circumstances of the case and also that the petitioner is in jail for more than one year, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10, 000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ashutosh Kumar Rai, Judicial Magistrate 1st Class, Patna City, in connection with Sultanganj P.S. Case No. 191 of 2013, subject to the condition that the petitioner shall file hazri in the nearest police station once in a fortnight for one year and one of the bailors shall be the close relative of the petitioner who will file affidavit to the effect that the petitioner shall not involve in such type of activity in future and if any report is received regarding his involvement in such type of crime, the Trial Court itself shall cancel the bail bond of the petitioner.
