Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. In the present case, the petitioner seeks bail in connection with Aurangabad Town P.S. Case No. 292 of 2021 registered for the alleged offence under Sections 379 and 411 of the Indian Penal Code.

The allegation against the petitioner is that of stealing a motorcycle and he was apprehended with the motorcycle along with some other stolen articles.

It has been submitted by the learned counsel for the petitioner that the petitioner is a mechanic and he was called to

Patna High Court CR. MISC. No.4966 of 2022(2) dt.09-06-2022 2/3 unlock the motorcycle and for this purpose he went along with his instrument. He was not even arrested from the spot and he was apprehended from his house. He is in custody since 26.07.2021.

Learned APP has opposed the prayer for bail, submitting that the petitioner was caught with the stolen property and some other articles.

Having regard to the submission made hereinabove and considering the period of custody, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad/court concerned in connection with Aurangabad Town P.S. Case No.292 of 2021, subject to the following conditions :

(i) The bail bond of the petitioner will be accepted only after framing of charge, if not already framed.

(ii) One of the bailors will be a close relative of the petitioner, preferably one of the parents. (iii) The petitioner will remain present on each and every date fixed by the court below.
