JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report nor has been put on T.I.P as yet. It appears that one co-accused Saiyad Saddab Anwar was arrested in Brahmpura P.S.case No. 263 of 2014 and made his confessional statement disclosing the name of petitioner and several other persons and on the basis of aforesaid confessional statement, petitioner has been made accused in this case.

Submission on behalf of the petitioner is that the petitioner has not only been made accused in the present case but also he had been made accused in several other cases only on the basis of above stated statement of co-accused. It is further

Patna High Court Cr.Misc. No.12044 of 2016 (2) dt.17-03-2016 2/2 submitted that petitioner has already been released on bail in some of the cases.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Laukahi P.S.Case No.121 of 2014.
