JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2019 This is an application for grant of anticipatory bail in connection with Darihat P.S. Case No. 101 of 2017, disclosing offences under Sections 147, 148, 149, 186, 341, 323, 504, 506, 337, 338, 332, 427, 333, 307, 120(B) and 353 of the Indian Penal Code.

Allegation against the petitioner and several other accused persons is that when the police has arrested some accused persons then the petitioner and others were attacked on police party and succeeded in helping of arrested persons in fleeing away. Further, it appears that the petitioner is accused in one more case of the same occurrence.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and nothing specific has been attributed against him. Further

Patna High Court Cr.Misc. No.1679 of 2019(2) dt.24-01-2019 2/2 submission is that other case is also with respect to the occurrence of present case.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Dehri-on-Sone, Rohtas at Sasaram, in connection with Darihat P.S. Case No. 101 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
