JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-364, 120(B), 34 of the Indian Penal Code. Petitioner is not named but in course of investigation, some witnesses expressed their suspicion about the involvement of the petitioner in the alleged crime. The victim has already returned to his home safely and his statement u/S 164 of the Cr.P.C. was recorded but in his statement, the victim has nowhere stated about the involvement of the petitioner and the petitioner is languishing in jail custody since 16-01-2016 but uptill now, he has not been put on Test Identification Parade and it appears that except the criminal antecedent and suspicion, there is nothing against the petitioner.
Patna High Court Cr.Misc. No.12418 of 2016 (2) dt.18-03-2016 2/2 Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kawakole P.S. Case No. 32 of 2015 to the satisfaction of Shri S. K. Mishra, learned Additional Chief Judicial Magistrate-IV, Nawada.
