The petitioner seeks bail in Andhra Math P.S. Case No. 36 of 2013, corresponding to Sessions Trial No. 16 of 2015, registered for the offences punishable under Section 364 and other Sections of the Indian Penal Code.
Devki Devi filed complaint petition alleging therein that the petitioner kidnapped her husband and on enquiry the petitioner and others disclosed that her husband had gone outside of the State to earn his livelihood.
It is submitted that the petitioner is the father-in-law of the informant. The informant earlier filed a case under Section 498A and other Sections of the Indian Penal Code against her husband and the petitioner. The husband of the informant went
Patna High Court Cr.Misc. No.21715 of 2015 (2) dt.18-06-2015 2/2 outside without informing the petitioner and taking advantage of this fact the informant lodged this false case. There is no material on record to show that the petitioner kidnapped his own son. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IInd, Madhubani in Andhra Math P.S. Case No. 36 of 2013, corresponding to Sessions Trial No. 16 of 2015. (Prabhat Kumar Jha, J.) KKSINHA/- U T
