JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner happens to be main assailant and it is alleged that he shot fire on the deceased as a result of which deceased died having sustained firearm injury. Petitioner carries criminal antecedent of near about five cases but submission on behalf of the petitioner is that the informant is not an eye witness of the alleged occurrence and as a matter of fact, petitioner has been implicated in this case on

No.12762 of 2016 (4) dt.18-04-2016 2/2 account of village politics Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 441 of 2015 arising out of Bypass P.S. Case No. 136 of 2014 pending in the court of Additional Sessions Judge-I, Patnacity, Patna stands rejected.
