JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 20-06-2022 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Sarai P.S. Case No. 195 of 2021 registered for the offence under Sections 302, 120(B), 394 and 384 of the IPC and Section 27 of the Arms Act.
The petitioner is named in the FIR and is in custody since 21.11.2021.
The allegation against the petitioner to commit murder of the husband of the informant along with other coaccused persons. Learned counsel appearing on behalf of the

No.4752 of 2022(2) dt.20-06-2022 2/3 petitioner submitted that as per the informant, who is the eyewitness of the alleged occurrence, specific allegation as regard to the fire arms assault is against co-accused, namely, Dharmendra Singh, causing death of the husband of the informant. It is further submitted that the petitioner is a man of clean antecedent.
APP appearing on behalf of the State while opposing the prayer for bail fairly conceded the fact that the specific allegation of firing is not against the petitioner. Considering the facts and circumstances as mentioned above, as allegation of firing is not against the petitioner rather the same is against co-accused, namely, Dharmendra Singh, let the petitioner, above named, is directed to be released on bail in connection with Sarai P.S. Case No. 195 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - XVI, Vaishali at hajipur subject to the following conditions:
"(i) Petitioner shall cooperate in the trial and shall be physically present on each and every date before the Trial Court till conclusion of the trial and exemption from physical appearance be allowed by the Trial Court only on medical
