The petitioner is accused in connection with Sultanganj P.S. Case No. 57 of 2015, registered under Section 386, 387, 379/34 and 411 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the theft vehicle was recovered from the house of co-accused Nago Mahto, where this petitioner was also found. Further submission is that the petitioner was apprehended there by the Police having country made pistol regarding which Parwatta P.S. Case No. 15 of 2015 was instituted, as detailed in para 3 of the bail petition. The petitioner is in custody since 30.04.2015.

Patna High Court Cr.Misc. No.13607 of 2016 (2) dt.08-04-2016 2/2 Further submission is that similarly situated co-accused Chandan Mandal has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 26.02.2016 passed in Criminal Misc. No. 6187 of 2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S. Case No. 57 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
