The petitioner seeks bail in Khagaria (Gangour) P.S. Case No. 175 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.
The informant named the petitioner along with Sudhir Mahto, Jagdish Mahto @ Tinku Mahto, Trivendra Mahto, Murari Kumar Rastogi and Nawal Kishore Sah and alleged that they all made indiscriminate firing causing injury on her body. Kailash Keshri and Ram Chandra Tanti committed theft in her house. Learned counsel for the petitioner submits that on similar allegation Nawal Kishore Sah against whom there is allegation of firing has already been granted bail vide order passed
Patna High Court Cr.Misc. No.5365 of 2015 (4) dt.29-04-2015 2/2 in Cr. Misc. No. 11092/2015. Kailash Keshri and Ram Chandra Tanti have also been enlarged on bail.
On perusal of record, it appears that Trivendra Mahton, Sudhri Mahto, Murari Kumar Rastogi, Ganesh Mahto and Nawal Kishore Sah are alleged to have made indiscriminate firing. The informant got as many as eleven injuries out of which many injuries are grievous. Nawal Kishore Sah the co-accused against whom the same and similar allegation is made has been granted bail by a Bench of this Court vide Cr. Misc. No. 11092/2015 and the case of the petitioner stands on same footing. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Gangour) P.S. Case No. 175 of 2014.
