====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-04-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 504, 506/34 of the Indian Penal Code.

3. As per prosecution case, all the 13 F.I.R. named accused persons including these petitioners are alleged to have assaulted husband of the informant by means of bricks.

4. Learned counsel for the petitioners submits that allegation of assault is general and omnibus and there is no specific allegation of overt act against these petitioners. As per

Patna High Court CR. MISC. No.10349 of 2025(2) dt.03-04-2025 2/2 F.I.R., 13 persons assaulted husband of the informant but doctor has found only one injury. It is further submitted that similarly situated co-accused has already been granted anticipatory bail by co-ordinate Bench of this Hon'ble Court vide order dated 17.12.2024 passed in Cr. Misc. No. 79000 of 2024. Petitioner Nos. 2, 3, 4 claim clean antecedent and petitioner No. 1 has got one criminal antecedent in which he is on bail.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-X, East Champaran, Motihari in connection with Kotwa P. S. Case No. 118 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
