JUSTICE PRABHAT KUMAR JHA ORAL ORDER 29-04-2015 Heard Shri Om Prakash Pandey, learned counsel for the petitioner, Shri Vivekanand Singh, learned counsel for the informant and learned counsel for the State.

The petitioner seeks bail in Kotwali (Tatarpur) P.S. Case No. 399 of 2012, corresponding to Sessions Trial No. 456 of 2013, registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act.

The prayer for bail of the petitioner was thrice rejected, this is the fourth attempt.

Learned counsel for the petitioner has submitted at bar that the prosecution case has already been closed after

Patna High Court Cr.Misc. No.5378 of 2015 (3) dt.29-04-2015 2/2 examination of all the witnesses produced on behalf of the prosecution. The statement of the accused has already been recorded and the case is fixed for defence witness. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.

Now the case is posted for defence evidence and the trial court is directed to expedite the case and conclude the same as soon as possible.
