Petitioner seeks bail in a case registered under sections 399, 402, 414/34 of the Indian Penal Code as well as sections 25 (I-b)a, 26,35 of the Arms Act.
Petitioner is said to have been caught by the police when he along with others assembled to make preparation for committing dacoity and according to the prosecution case itself, only two mobile sets were recovered from conscious possession of the petitioner who does not have any criminal antecedent and is languishing in jail custody since 24.12.2015.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in Madhepura (Bharrahi) P.S. Case no. 671/2015. shahid (Hemant Kumar Srivastava,J) U T
