The alleged occurrence appears to have taken place on account of land dispute and only bricks and stones are said to have been used for committing the murder. No doubt petitioner is named in the first information report but no specific overt-act has been attributed against him. Petitioner is in jail custody since 20.11.2015 and investigation against him has already been completed and further detention of the petitioner as under trial prisoner, does not appear to be essential.

Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of ACJMV, Katihar in Barari P.S.Case No.199 of 2015. (Hemant Kumar Srivastava, J) B.Kr./- U T
