The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 307, 379, 504, 34 of the Indian Penal Code.

Allegation against the petitioners is of assaulting the informant and his Bhatija with lathi and also took away the golden chain.

Learned counsel for the petitioners submits that both parties are own relatives. It is submitted as a matter of fact motorcycle met with an accident. In that accident both parties entered into free

Patna High Court CR. MISC. No. 2356 of 2020(2) dt.27-02-2020 2/2 fight and later on lodged cases against each other. The petitioners have got no criminal antecedent.

In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-X, Gaya, in connection with Nimchak Bathani P.S. Case No. 135 of 2019, on the following conditions: "(1) Petitioners shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on their absence on two consecutive dates without sufficient reason, their bail-bonds shall be cancelled by the Court below.

(2) If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bails."
