The petitioner seeks regular bail in connection with Hisua P.S. Case No. 119 of 2019 instituted for the offences under Sections 302, 201 and 120(B) and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 18.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that informant has stated that the marriage of the informant's daughter was solemnized with Amrendra Kumar @ Gorelal about seven years back. Patna High Court CR. MISC. No.5164 of 2022(2) dt.07-06-2022 2/3 the deceased used to assault her. The informant went to Oro village several times to reconcile but all was in vain. On 23.03.2019, his daughter called him at about 09:00 A.M. and told that she would be killed and when the informant went to the Oro village then he did not find his daughter. It was informed by the villagers that in-laws of her daughter had killed her and burned her corpse at burial site.
Learned counsel for the petitioner submits that during the investigation found by the police in order to show culpability of the petitioner with the alleged offence. Further, it is submitted that petitioner has been made accused in the present case only because he is the father-in-law of the deceased. It is further stated that husband of the deceased has already been granted bail by a co-ordinate Bench of this Court vide order dated 20.01.2021 passed in Cr. Misc. No. 32085 of 2020. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 18.09.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two
