JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2019 Since both the above-mentioned cases arise out of same police station case number, hence they are clubbed together and are being disposed of by this common order for the sake of convenience. This is an application for grant of anticipatory bail in connection with Piro P.S. Case No. 254 of 2018, disclosing offences under Sections 420, 467, 468, 471 of the Indian Penal Code. Petitioner Nitu Kumari in Cr. Misc. No. 189 of 2019 is an

Patna High Court Cr.Misc. No.70 of 2019(3) dt.08-02-2019 2/2 Assistant and the allegation against her is of demanding money from the beneficiaries along with her husband, who is petitioner in Cr. Misc. No. 70 of 2019.

Submission of learned counsel for the petitioners is that number of beneficiaries have been examined and during course of examination none of them have named the petitioners. Further they have no criminal antecedents.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances of the case, as stated above, let petitioner Nitu Kumari in Cr. Misc. No. 189 of 2019 and petitioner Mantu Singh in Cr. Misc. No. 70 of 2019, surrender within a period of six weeks from the date of receipt of the order and on surrender, they will be released on provisional bail till submission of charge-sheet with condition to cooperate with the Investigating Officer and produce all papers before him, if required and if charge-sheet is submitted against the petitioners, they have to surrender and make prayer for regular bail, which shall be considered on its own merits, without being prejudice by order of this Court.

With the above observation, this application is disposed of.
