The petitioner is languishing in custody since 13.01.2016 in a case registered for the offences punishable under sections 8/20(a)(i)/29 of The Narcotic Drugs and Psychotropic Substances Act.
From the 'khalihan' of the petitioner four cannabis plants were recovered.
It is submitted by learned counsel for the petitioner that it has not been verified that the place from where recovery has been made belongs to the petitioner and even assuming the accusation, straw plants cannot come within the preview of cultivation under NDPS Act.
