The appellant isapprehending his arrest in connection with Pachrukhi (Sarai) P.S.Case no.150 of 2018 , registered for offences punishable under Sections 147, 148, 149, 323, 341, 342,333, 353, 307 of the Indian Penal Code and Sections 3(1)(r) (s), 3(2)(va) of S.C./S.T. (Prevention of Atrocities) Act. Allegation against the appellant and other accused persons is of assaulting the ASI by fists and slaps. Submission of the learned counsel for the appellant is that large numbers of persons altogether 14 persons are named and 50-60 persons are un-named and no specific allegation has been attributed against the appellant and he has no criminal antecedent.

APP (SJ) No.187 of 2019 dt.27-02-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the appellants , above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge cum Special Judge, Siwan in connection with A.B.P. No.1384 of 2018 arising out of Pachrukhi (Sarai) P.S.Case no.150 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. Accordingly, this appeal is allowed and the impugned order is set aside.
