The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code and 27 of the Arms Act. The informant named seven persons including the petitioner and alleged that Nand Singh assaulted his mother with butt of gun and blood started oozing. When Anita Kumari, daughter of the informant, came out, Nand Singh fired which hit Anita Kumari. Dhanjee Singh also fired but his shot did not hit anybody.

It is submitted that the petitioner of course is named in the F.I.R. but no specific allegation of firing or assault is made against him. The petitioner is in jail since 7.1.2015. Considering the facts aforesaid and the fact that there is

Patna High Court Cr.Misc. No.20686 of 2015 (2) dt.17-06-2015 no allegation of assault or firing against the petitioner, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Basant Kumar, Judicial Magistrate, 1st Class, Bikramganj (Rohtas), in connection with Nasriganj (Rajpur) P.S.Case No. 01 of 2015.
