The petitioner seeks bail in a case registered under Section 302 and other sections of the Indian Penal Code. The petitioner is not named in the F.I.R. Name of the petitioner firstly figured in the case from the mouth of a spy of the police. Thereafter, the police recorded the statement of Anuj Singh in Para 56 of the case diary. Anuj Singh disclosed the names of Bouka Chaudhari, Suraj Chaudhari, Shambhu Yadav, Avnish Kumar, Barish Kumar (the petitioner), Kare Lal Yadav, Manoj Rai and 10-12 unknown persons. It is submitted that Avnish Kumar @ Avnish Kunwar, Kare Yadav, Manoj Rai, Suraj @ Dhiraj Chaudhary have been granted bail by this Court vide orders passed in Cr. Misc. Nos. 39502/2014, 42391/2014 & 51060/2014. The case of the petitioner stands on the same footing.

No.21555 of 2015 (2) dt.18-06-2015 2/2 Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Naugachia, District - Bhagalpur in Bihpur P.S. Case No. 402/2013.
