The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise(Amendment) Act, 2018. The prosecution case is that from the hutment of the petitioner, 4.500 litres of Indian Made Foreign Liquor was recovered.

It is submitted by learned counsel for the petitioner that the petitioner is an old lady and she had already disowned the said hutment in question before the recovery and statement to that effect has been made in paragraph 8 of the petition which reads as follows:

"That, the petitioner has got no concern with the alleged hut from where liquor has been recovered."

Patna High Court CR. MISC. No.4395 of 2020(2) dt.28-02-2020 2/2 Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the recovery of illicit liquor has been made from the hutment of the petitioner. Considering the recovery being made from the hutment which was disowned by the petitioner before recovery, who is a lady, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ II-cum-Special Judge, Excise, Vaishali at Hajipur in connection with Desari P.S. Case No.357 of 2019 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
