The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code and sections 30(a)/32/36/41 of the Bihar Prohibition and Excise Act. 1548 litres of foreign liquor has been recovered from a truck.
It is submitted that nothing has been recovered from conscious possession of this petitioner. Name of petitioner transpired in this case on the basis of confessional statement of co-accused Shivam Thakur. Petitioner is neither driver nor owner of vehicle in question and has got no concern with the

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Jhanjharpur, Madhubani in connection with Bhairavsthan P.S.
