The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 302, 188 of the Indian Penal Code.

The prosecution case as per F.I.R is that all the accused persons including petitioner and 3-4 unknown, variously armed, surrounded the informant and his father and made assault, as a result of which, they sustained injuries. The father of the informant subsequently succumbed to the injuries.

Patna High Court CR. MISC. No.4117 of 2022(3) dt.25-07-2022 2/3 It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. There is counter version of the occurrence also and petitioner's side also received injuries. As per allegation, six named and four unknown accused have assaulted the informant and his father but the postmortem report of the deceased suggests that deceased sustained only one injury i.e. one lacerated wound 3'x1 1⁄2' x bone deep at mid parietal region on head and no other injury was present on the body and cause of death is hemorrhage and shock due to head injury. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)

No.4117 of 2022(3) dt.25-07-2022 3/3 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Pakribarawan P.S. Case No. 80 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
