The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Pipra Kothi P.S. Case no. 217 of 2023 instituted for the offence under Sections 304(B)/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.

It is a case of dowry death due to non fulfillment of dowry demand.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.9648 of 2024(4) dt.21-06-2024 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in the present case. There is no prior complaint of torture and dowry demand. It is further submitted that petitioner is devar of the deceased and he has no concern with the mess and business of the deceased as well as her husband. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Pipra Kothi P.S. Case no. 217 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/-

Patna High Court CR. MISC. No.9648 of 2024(4) dt.21-06-2024 3/3 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
