The two petitioners herein are lodged in custody since 15.10.2012 and 10.11.2012 respectively. They are accused(s) of the offence punishable under section 395 IPC and section 27 of the Arms Act.
Learned counsel for the petitioners submits that on the confessional statement of the co accused Ramesh Yadav the petitioners have been apprehended in this case. Explaining certain paragraphs which have been noted by the Sessions Judge, it is stated that other accuseds have only made confessional statements which find mentioned in the relevant paragraphs noted by the
Patna High Court Cr.Misc. No.21105 of 2015 (2) dt.10-07-2015 2/2 learned Sessions Judge. Except one case which is pending against the petitioner under sections 399 and 402 IPC there is no other case pending against them.
Considering the materials on record and particularly the period of incarceration, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction SDJM, Raxaul at Motihari, East Champaran in Ramgarhwa P.S. Case No. 119 of 2012 on condition that one of the bailors of each of the petitioners shall be their own/close family members. As soon as the charges are framed, the petitioners shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel their bail bonds.
