JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Laheriasarai P.S. Case No. 571 of 2013 registered for the offences punishable under Sections 409, 420/34 of the Indian Penal Code. Allegedly, the petitioner being a rice miller was to deposit the defalcated amount of Rs. 16,64,822/- and he deposited only Rs. 6,00,000/- and rest Rs. 10,64,822.45/- remained dues. Submission is that for the aforesaid amount a certificate case was also filed against which C.W.J.C. No. 6632 of 2014 has been filed and in that case the petitioner was directed to deposit Rs. 2,00,000/- and accordingly, he deposited the said amount and further it has been submitted that many similarly

Patna High Court Cr.Misc. No.30959 of 2014 (2) dt.27-01-2015 situated co-accused have been allowed pre-arrest bail, and as such, the petitioner deserves sympathetic consideration to which the learned APP does not dispute.

In the facts and circumstances stated above, the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 571 of 2013, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
