Mr.Sri Arun Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-07-2019 Case is under Section 498(A0 of the IPC. Petitioner happens to be husband and on appearance of O.P.no.2 the matter was referred to the Patna High Court Mediation and Reconciliation Centre, however, the report submitted by the Mediator disclose that the dispute can not be resolved through the process of mediation.

It appears that at the time of marriage, the petitioner had taken Rs.01 lac and now he is ready to pay the same. Heard learned APP and the learned counsel for the O.P.no.2 also, who has no objection to such proposal. In view of the above facts and circumstances let the petitioner surrender before the learned court below by 14.8.2019 with a bank draft of Rs.01 lac in favour of O.P.no.2 and once the same is deposited the petitioner shall be released on bail on

Patna High Court CR. MISC. No.729 of 2019(8) dt.09-07-2019 2/2 bail bonod of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Purnea in connection with Mahila P.S.Case No.28 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

It is needless to say that the amount so deposited shall be released in favour of O.P.no.2 on filing an application by her. Since the matter appears to have been settled between the parties, both parties may take steps for withdrawal of the cases filed against each other.

With the aforesaid direction, this application is disposed of.
