JUSTICE ARUN KUMAR JHA ORAL ORDER 20-03-2024 This is the second attempt of the petitioners to seek bail from this Court as their prayer for bail was earlier rejected by this Court vide order dated 31.08.2022 passed in Cr. Misc. Nos. 71442 of 2021 and 65505 of 2021, respectively.

Pursuant to order dated 02.02.2024, a report dated 29.02.2024 has been received from learned trial court, wherein it has submitted that the statement of the accused persons were recorded under Section 313 of the Code of Criminal Procedure on 09.02.2024 and thereafter, the matter has been coming up for regarding the evidence of defence witnesses and two witnesses were produced, examined and discharged on 29.09.2024 on behalf of the defence and there are altogether 18 witnesses to be examined by the defence.
3. Learned senior counsel appearing on behalf of the petitioner of Cr. Misc. No. 74641 of 2023 submits that the petitioner is a lady and she is in custody since 26.07.2021.
4. Evidently, the prosecution evidence has been closed and statement of the accused persons has already been recorded under Section 313 of the Code of Criminal Procedure and the matter has been coming up for recording the evidence of defence witnesses. The trial at its fag end, this Court is not inclined to consider the prayer for bail made by the petitioners afresh at this stage as it is the second attempt of the petitioners for grant of bail. The petitioners are directed to get their evidence concluded and the learned trial court is directed to dispose of the matter at the earliest after recording of evidence
