JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 307 and other allied Sections of the Indian Penal Code. Petitioner is named in the first information report along with others on the accusation that he and others brutally assaulted the informant and his brother.

Submission on behalf of the petitioner is that the petitioner was granted privilege of anticipatory bail by a Coordinate Bench of this Court vide order dated 13.10.2015 passed in Cr. Misc. No.44400 of 2015, but unfortunately, petitioner left to mention criminal antecedent of one case in paragraph-3 of this petition filed for grant of anticipatory bail and taking note of the aforesaid fact the petitioner was denied the privilege of

Patna High Court Cr.Misc. No.12385 of 2016 (2) dt.18-03-2016 2/2 anticipatory bail and was taken into custody. It is further submitted that moreover, having more or less similar allegation, some coaccused have already been granted privilege of anticipatory bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Siwan in connection with Bhagwanpur P.S. Case No.74 of 2015.
