In this case, the petitioner is seeking anticipatory bail in connection with Sheikhpura P.S. Case No.465 of 2018, registered for the offence punishable under Sections 147, 148, 149, 323, 307, 353, 379, 427, 337, 338 of the Indian Penal Code, Section 3/4 Prevention of Damage to Public Property Act and 40 B.M.M.C. Act.

As per the First Information Report lodged by the Mining Inspector that in course of inspection of Block No.6 five vehicles were found overloaded with illegal stone chips. Learned counsel for the petitioner submits that neither the petitioner is owner of vehicles nor he has ownership

Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura P.S. Case no.465 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
