JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code.

As per the prosecution case, this petitioner and other accused persons used to tease, harass and misbehave with the deceased prior to the occurrence as a result of which she committed suicide.

Learned counsel for the petitioners submits that the petitioner is innocent and has falsely been implicated in this case. There is no eye witness of the occurrence. It is further submitted that prior to the occurrence there was an altercation between the informant and accused persons for irrigation of land and due to that petitioner has been made accused in this case.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Munger in Bariyarpur Police Station Case No. 77/2021.
