JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with G.O. Case No. 1275 of 2019 arising out of P.R. No. 27 of 2019, registered under Section 30(a) of the Bihar Excise Act. The accusation is of recovery of 1200 bottles each containing 300 ml Nepali liquor kept in a sack from the Mahindra XYLO vehicle, in which, petitioner and Mohan Prasad Gupta were found sitting.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 12.12.2019.

Having regard to the facts and the circumstances of

Patna High Court CR. MISC. No.15204 of 2020(3) dt.14-05-2020 2/2 the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-Cum-Special Judge (Excise), Darbhanga, in connection with G.O. Case No. 1275 of 2019 arising out of P.R. No. 27 of 2019. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
