The petitioner is in custody since 4.4.2014 in a case registered under Section 365 of the Indian Penal Code. The prosecution case, in brief, is that one Sudhir Sah gave a written application to the Officer-in-Charge of Gopalpur Police Station, District-Bhagalpur on 25.3.2014 alleging, inter alia, therein that on the said date at about 6.30 P.M., he was at his shop at Pachgachia near Thakurbari and after closing the Jewellery shop returned back to his home and his son Jitendra had not returned his home and he is aged about 18 years having fair complexion and wearing T. Shirt and black pant. It has been further stated that he was traceless from way.

It is further submitted that in his statement made under Section 164 of the Cr.P.C., the victim has not named the petitioner. On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Naugachia, District-Bhagalpur, in connection with Gopalpur P.S.
