JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 This is an application for grant of anticipatory bail in connection with Rajpur P.S. Case No. 247 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act 2016.

Allegation is of recovery of 8.64 liters liquor from the house of the petitioner. Further it appears that the petitioner is accused in two other cases, one is of similar type. Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and seizure list does not contain signature of any of the family member of the petitioner. Though he is accused in two cases, but he is on bail.

Heard learned A.P.P. also.

Having heard both sides, considering the above facts

Patna High Court Cr.Misc. No.1081 of 2019(2) dt.17-01-2019 2/2 and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court, if possible on the same day.

With the above observation, this application is disposed of.
