2. The petitioner seeks bail in Paliganj P.S. case No. 560 of 2023 instituted for the offences under Sections 420, 308, 467, 468, 34 of the Indian Penal Code and Section 34(2) of National Medical Commission Act, 2019..

3. Prosecution case, in short, is that on a raid conducted by the police, it was found that surgery was being done in a private hospital and, on inquiry, the accused persons failed to produce any paper for running the hospital and also conducting the operation.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. Charge-sheet has been submitted in this case. Learned counsel

Patna High Court CR. MISC. No.4781 of 2024(2) dt.12-02-2024 2/2 for the petitioner submits that the petitioner has got no concern with the alleged nursing home. The name of the petitioner has transpired as being owner of the building in question the nursing home was running. The petitioner submits that the said building was given by her on rent. There is no direction allegation alleged against the petitioner. The petitioner is in custody since 18.10.2023 and has no criminal antecedent

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, the period of custody undergone by the petitioner and the clean antecedent of the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Paliganj P.S. case No. 560 of 2023.
